1. GENERAL

In the next conditions Technische Handelmaatschappij J. de Wild BV, acting as GTM Professional, is referred as "seller" and the consumer as "buyer".

The web shop of the seller offers consumers the possibility to purchase online.

Seller has at all times the right to amend these general conditions and the content of the website. Seller spends a lot of care on the website. Seller however is not bound, in case of error, such as for instance – but not exclusively – error in price and printing error, on the website.

2. APPLICATION

These general conditions (B2C) apply to all agreements and deliveries by seller as entered into with buyer, respectively does on the basis of an order by buyer via the web shop of seller.

3. OFFERS

3.1 All offers by seller are free of obligation. If an article is not in stock, seller and buyer have the right to provide or receive a similar product instead of the ordered product or to dissolve the agreement.

3.2 Offers are valid for as long as supplies last.

4. AGREEMENT

4.1 As the result of buyer’s order plus acceptance of such by seller a purchase at a distance is realised between buyer and seller. The correctness of the data as entered by the buyer when ordering is at the expense and risk of the buyer.

4.2 Concerning the realisation of the agreement to the purchase at a distance an email message of confirmation will be sent by the seller to the buyer.

4.3 All orders must be completed by advance payment. Only after complete payment of the order, this order will be processes and shipped.

4.4 Seller retains the right to, in individual cases, reject an order without the possibility to claim reasons.

4.5 The cancellation of an already confirmed order is possible only if buyer during office hours makes contact via telephone with the sales service. The sales service will, based on the status of the order concerned, assess whether it is still possible to cancel the shipment.

4.6 Seller retains the right, in the event of unforeseen circumstances, to deliver an order incomplete. Seller will inform buyer about this as soon as possible whereby buyer is obliged to only pay for the goods delivered.

5. PRICES

5.1 All prices are exclusive of shipment costs and inclusive of taxes. Any shipping costs will be stated separately.

5.2 Seller retains the right to correct the prices that are stated in the email of confirmation in the event of mistakes such as for instance printing errors or omissions.

5.3 Seller is not liable for such unforeseen errors or omissions.

6. RETURNS

6.1 The buyer is entitled to return the received product within 14 days after receiving it, to the seller. A statement of reasons is not required in this case. Condition is however that the buyer includes the original invoice, the article is not damaged or used and that it is still in its original packaging. If these conditions are not met the seller is not obliged to accept the return sending. The costs and risk involved in the returning are for the buyer. Seller will refund the paid purchase price to buyer as soon as possible, in any case within 30 days after the date of returning.

6.2 If the buyer has received a damaged product, this will be exchanged by seller for the same product without any costs, under the condition that buyer states such an event within a reasonable period of time following discovery of the non-conformity of the product; buyer still holds the invoice, the product has not been used and still is in the original packaging. To this purpose buyer should, after receiving the product at the delivery address contact the sales service of seller, whereby a period of 2 months is considered timely.

6.3 If buyer has returned products, buyer must be able to show proof of forwarding.

7. GUARANTEE

7.1 Warranty is handled according to the European Directive 1999/44 / EG or according to the legislation of the residing country of the buyer should this deviate.

7.2 The product that is eligible for assessment of guarantee must be sent back to the seller. Transport costs are not covered by the guarantee.

7.3 The guarantee generally includes the errors that may appear in the material, construction or finishing and does not include damage resulting from transport, improper use and / or wear and tear of parts that precisely have the function to wear: the wearing parts.

7.4 A product that is eligible for assessment of guarantee will, if possible, in first instance be repaired.

8. APPLICABLE LAW

The Dutch Law is applicable. Any dispute among parties for which no amicable settlement can be achieved, will be presented to the competent court in Breda.
